Obama's Embarrassing Court Losses

     If the Supreme Court rules Obamacare unconstitutional on Thursday, as many expect, liberals will no doubt cry that it’s a biased and unfair conservative court.  They will shout from the rooftops that Obamacare was perfectly constitutional – and it’s the court that has it all wrong.

    However, they will as always, be ignoring the facts to make such claims. 

    The facts are these.  The leftist Obama administration is so out of sync with what the Constitution and what America stand for that they have lost more cases than almost any other president.  

    Normally, the court gives deference to any administration.  Presidents normally win 60%-70% (page 18) of the Supreme Court cases they’re involved in.  However, the Obama administration has turned those averages on their head.  He’s barely winning 35%.  Liberals will claim this is because the court is so conservative.  But it’s not.  It’s 4-4 with one swing vote.  And this claim ignores the fact that all the liberal justices, including Obama's two appointees, have voted against him on more than one occassion.  The reason the Obama administration has lost so many cases at the Supreme Court is because he is involved in a crusade to push America as far to the left as he possibly can.  And that means pushing America as far away from the Constitution as he can.

    Even the liberal justices oppose him at times.  In the Arizona Immigration case heard earlier this year, Justice Sotomayor – an Obama appointee – told Obama’s solicitor general that his arguments were “not selling very well”.  

    The court has now ruled against Obama's stand on the Arizona immigration law.  It had previously ruled against the administration's position that Arizona couldn't take away business licenses from Arizona businesses that hired illegal aliens.  And earlier this year, the Court called a decision by Obama's Board of Immigration Appeals "arbitrary and capricious" as well as "irrational"!


    In another case on religious liberty, the Court ruled against the administration again when they tried to assert the right of government to decide who should be hired and fired in religious institutions.   http://www.supremecourt.gov/opinions/11pdf/10-553.pdf

    In Salazar v. Ramah Navajo Chapter, the administration sought to withhold promised payments to an Indian tribe.  The Obama lawyer argued that the Indians shouldn’t be paid!  But the court ruled they must be paid because they had a contract with the government stating that they would be paid.  Even Obama-appointed Justice Sotomayor couldn’t go along with this and she voted against him.   http://www.scotusblog.com/case-files/cases/salazar-v-ramah-navajo-chapter/

    In the GPS Vehicle Surveillance case, the administration argued that there was no need for a search warrant before tracking a defendant’s vehicle with a GPS device.  This opinion was so egregious that Justices Alito, Ginsburg, Breyer and Kagan all agreed that the administration was wrong.  http://www.scotusblog.com/case-files/cases/united-states-v-jones/


    Sackett v. Environmental Protection Agency - the Obama Administration fought hard to prevent businesses from bringing civil actions to challenge the issuance of EPA orders requiring them to take certain actions with respect to their own private property.  The Court ruled UNANIMOUSLY against the administratin, 9-0!  This was such a flagrant violation of the Constitution that not even the liberals could go along. http://www.scotusblog.com/case-files/cases/sackett-et-vir-v-environmental-protection-agency-et-al/

    To have his own very liberal appointees voting against him time and time again shows just how radically anti-American and anti-Constitution Barack Obama is.  All his Court losses cannot be blamed on a biased conservative Supreme Court.
